Trolley King - Terms and Conditions

1. Acceptance of Terms

By purchasing or using any Trolley King product or service, you ("The Customer") agree to be bound by these Terms and Conditions.

2. Product Use

  • Intended Use: Trolley King adventure trolleys are designed for recreational use on suitable terrain.
  • Safe Operation: Customers are solely responsible for the safe and appropriate operation of the trolley, including adhering to weight limits, operating within safe parameters, and following all applicable safety guidelines.
  • Terrain Limitations: Using the trolley on unsuitable terrain, may cause damage to the trolley and may be dangerous.
  • Weight Limits: Exceeding the weight capacity of the trolley may cause damage to the trolley, create safety hazards, and may void the warranty.

3. Disclaimer of Warranty

  • Limited Warranty: Trolley King provides a limited warranty against manufacturing defects for a period of 60 days from the date of purchase. This warranty does not cover normal wear and tear, damage caused by misuse, negligence, accidents, or unauthorized modifications.
  • No Other Warranties: Except as expressly stated herein, Trolley King disclaims all other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. 
  • Warranty Claims: For any warranty claim the customer is liable for delivery and collection of the the item and any costs that maybe associated with it.   

4. Limitation of Liability  

  • No Liability for Damages: In no event shall Trolley King be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data loss, or injury, arising from the use or inability to use the trolley, even if Trolley King has been advised of the possibility of such damages.  
  • Assumption of Risk: By using a Trolley King trolley, the Customer assumes all risks associated with its use, including but not limited to the risk of injury, property damage, and environmental impact.

5. Indemnity

The Customer agrees to indemnify and hold harmless Trolley King and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys' fees) arising from or related to the Customer's use of the trolley, including any violation of these Terms and Conditions.  

6. Intellectual Property

All trademarks, logos, and other intellectual property rights associated with Trolley King are the exclusive property of Trolley King and are protected by applicable laws.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.   

8. Modifications

Trolley King reserves the right to modify these Terms and Conditions at any time without prior notice. The revised Terms and Conditions will be effective upon posting on the Trolley King website.
